Terms of Use for the “Mobiliteit.lu” app

   1. General data protection information

Protecting your personal data is very important to us. That is why, before you start, we want to tell you about how we protect your data when you use our app.

It is entirely possible to use our app without entering any personal data. However, if you wish to take advantage of certain special functions of our app (e.g. localisation), we may need to process some personal data. We guarantee that we will only collect and use personal data where this is necessary in order to provide you with a fully functioning app and all our content and services.

As the body responsible for processing the personal data that is collected, the Administration des transports publics undertakes to use the data as defined under the EU General Data Protection Regulation 2016/679 (hereinafter “GDPR”).

1. Data collection and processing

HaCon Ingenieursgesellschaft mbH only collects and processes your data for specific purposes. It may be required for technical reasons or to meet specific user requests.

• Personalised account

The app allows for users’ data to be saved on servers or individual devices. Saving data on the server enables the user to access it from any device. The data is used to make the app more user-friendly.

• IP address
  Due to technical and safety reasons, the IP address is stored for 60 days on the servers of HaCon Ingenieursgesellschaft mbH.
• Push notifications and newsfeed
  The app uses an app ID to send you push notifications. Push notifications are short messages which are displayed on your device even if you do not have the app open, for example about delays on a particular transport service. By having push notifications activated, users are giving their consent for their app ID to be saved in a database. You can deactivate the sending of push notifications in the app settings or your device settings and in this way withdraw your consent at any time.
• Cookies

Cookies are saved to allow the use of convenient functions such as “Your last search”.

• Collection of user’s location data

The app offers you services and information relating to the area around where you are, so that you can use your current location as your journey start or destination, or find your nearest public transport stops. In order for you to be able to use this service, your current location needs to be transmitted. The app will record your location, but only if you have allowed this in your device’s settings. The data is only used in order to find the information that you are requesting. You can deactivate access to your location data in your device settings and in this way withdraw your consent at any time.

• Favorites
  The app allows you to save “addresses” as Favorites on your device. The data is processed to create a customised user interface for you so that you can call up and use certain content and services more quickly. You can delete your Favorites in the app at any time and in this way withdraw your consent.

1. How long is data stored for?

We only save your data for as long as is required to serve the purpose for which it was collected or for as long as is legally required. The data is then kept for the legal retention period.

Users’ personal data which is server-based is stored and kept on servers operated by HaCon Ingenieursgesellschaft mbH in Hannover in Germany.

1. Your rights as a user

Under the EU General Data Protection Regulation 2016/679, all users have the right to:

• access and obtain information about their personal data
• ask for their personal data to be corrected or deleted or for processing to be restricted
• ask for their personal data to be sent to them
• withdraw their consent for their personal data to be processed
• register a complaint with the national data protection authority. The supervisory authority responsible for the Administration des transports publics is the Commission Nationale pour la Protection des Données (C.N.P.D.), 1 Avenue du Rock’n’Roll, 4361 Esch-sur-Alzette (www.cnpd.lu).
