General Terms and Conditions of Use for the “mBox Product and Service” contract
The “mBox Product and Service” is free. It is managed by the Public Transport Board (Administration des transports publics), 4 rue Charles Bernhoeft, L-1240 Luxembourg.

1. General remarks & definitions
For the purposes of these terms and conditions of use, the following definitions apply:
1.1. mBox: a locked facility equipped with a secure door which can be opened with the mKaart.
1.2. mBox product: the means of access to the mBox service, which is transferred onto the mKaart.
1.3. mBox service: free service for provision of a parking space for a cycle, as defined in Point 1.10.
1.4. mKaart: card with a multifunction chip, on which the access key for the mBox service is recorded.
1.5. Applicant: any private individual who requests to be registered with the mBox service.
1.6. User: any private individual registered with the mBox service in accordance with the modalities required under these rules.
1.7. Mobiliteit.lu (Call center): communication and information platform for mBox service users.
1.8. m-box.lu: the online service of the Public Transport Board, enabling a request to register for the “mBox Product and Service” to be submitted by providing an online form for this.
1.9. Pick-up: charging points enabling products to be transferred onto the mKaart.
1.10. Cycle: collective term for bicycles and for assisted pedal cycles which are authorised to park in the mBox facilities. For an official definition of these two terms, please consult Points 2.15 a) and c) of Rubric 2 – Vehicles in Article 2 of the Code de la Route (Luxembourg Highway Code).
2. Modalities for registration
2.1 Registration is exclusively online, via the m-box.lu website.
2.1.1. The applicant holds a valid mKaart: the applicant can order his/her mBox product via the online form available on our website m-box.lu. The applicant must fill in all mandatory fields when submitting the registration request and can collect the product ordered the next day, from one of the Pick up points.
2.1.2 The applicant does not have a valid mKaart: the applicant can order his/her mKaart, preloaded with the mBox product, via the website. The card will be send by post to the address given on the form when submitting the request to register for the service. Only addresses in the Grand Duchy of Luxembourg and in the Greater Region are accepted, i.e. addresses in the following areas: Saarland, the “Grand Est” region, the Grand Duchy of Luxembourg, the Rhineland-Palatinate, the Walloon Region with the French-speaking Community of Belgium and the German-speaking Community of Belgium.
2.2. Supply of the mBox product is subject to acceptance by the user of these general terms and conditions of use.
Failure to provide the required personal data will prevent the delivery of the mBox product.
2.3. The mBox product is supplied to the applicant as soon as possible and free of charge, once his/her registration has been validated in accordance with Points 2.1 and 2.2.
3. Obligations and responsibilities of the mBox service user
3.1. Registration for the mBox service gives the right to use the full mBox offering.
3.2. Entry to mBox facilities is only authorised for cycles, as defined in Point 1.10.
3.3. Use of the mBox service is strictly personal and cannot be transferred to a third party in any circumstances. To access the facility, the user must scan his/her mKaart using the card reader installed for that purpose on the entrance to the mBox.
3.4. Use of the mBox service entitles the user to park one cycle per mBox.
3.5. The user should ensure that the cycle is protected by securing it with a padlock or some other means of protection. He/she should similarly ensure:
- That he/she is not blocking the entrance or the central walkway of the mBox,
- That the door to the facility is properly re-closed every time he/she enters and leaves the mBox,
- That he/she does not leave item(s) or packages apart from the cycle inside an mBox.
3.6. The user certifies that he/she has civil liability insurance cover.
3.7. The user undertakes not to park his/her cycle for more than 30 consecutive days in an mBox, without using it.
3.8. Any cycle parked for more than 30 consecutive days without being used may be removed from an mBox by the Public Transport Board. Once this 30-day period is exceeded, the users concerned will be notified of this procedure by their cycle being tagged with a notice to that effect, for a period of two weeks at most.
3.9. In the event of loss or theft of the mKaart containing the mBox product, the user undertakes to notify the Public Transport Board immediately:

Replacement of an mBox product is free of charge.
4. Rights and responsibility of the Public Transport Board
4.1. The Public Transport Board reserves the right to refuse or to disable access to mBox facilities in the event of a failure to comply with these terms and conditions of use.
4.2. Given that the purpose of the “mBox Product and Service” contract relates exclusively and solely to the parking of the cycle, the Public Transport Board is not responsible for the safekeeping of the said cycle and is consequently in no way responsible on the user’s behalf for the state of preservation of the cycle parked in an mBox. In effect, the user consigns his/her cycle to an mBox under his/her own responsibility.
4.3. The responsibility of the Public Transport Board and of the National Railway Company (Société nationale des chemins de fer), together with that of their personnel, shall not be engaged in the event of theft or deterioration in the condition of a cycle parked in an mBox.
4.4. An mBox may be accessed subject to the limit of the available parking spaces. The Public Transport Board cannot be held responsible in the event that no parking space is available.
4.5. The Public Transport Board reserves the right to temporarily close one or more mBox facilities, notably for urgent works or due to exceptional circumstances (e.g. in the event of force majeure). The Public Transport Board will do everything within its power to alert the users concerned as quickly as possible.
5. Operation
5.1. The mKaart should be passed in front of the card reader in order to trigger release of the mBox door.
5.2. A computerised record of the use of the mKaart is made each time the mKaart is scanned by the reader. This record is solely intended to determine the level of use of the mBox.
5.3. In the event that the mBox product is not used for a period of over 12 months, the mBox product will be automatically deleted from the mKaart.
6. mBox product or mBox service malfunction
6.1. Any anomaly associated with use of the mKaart or of the mBox product should be reported to the Public Transport Board:

6.2. The user should state his/her mKaart number, the location of the mBox and the nature of the anomaly experienced.
6.3. In the event of a system malfunction, the Public Transport Board undertakes to make every effort and to intervene as quickly as possible to ensure availability of the mBox service.
7. Terminating the “mBox Product and Service” contract
7.1. The Public Transport Board may terminate the contract where the user fails to comply with these general terms and conditions.
7.2. The user can terminate his/her “mBox Product and Service” contract at any time without giving reasons, by sending a request in writing either by letter to the Public Transport Board at Administration des Transports Publics B.P. 640 L-2016 Luxembourg, or by e-mail to service@verkeiersverbond.lu
8. Validity
8.1. The mBox product remains valid, unless it has not been used for over 12 months.
8.2. In the event of the mBox product expiring, the user should submit a new request to register for the mBox service (see 2.1.1. and 2.1.2.).
9. Protection of personal data
9.1. Managing the “mBox Product and Service” requires the processing of personal data under the responsibility of the Public Transport Board. This processing is undertaken on the basis of Article 6 Point b) of the General Data Protection Regulation (GDPR) of 26 April 2016, i.e. that “processing is necessary for the performance of a contract to which the data subject is a party.”
The processing of the data enables the Public Transport Board to:
- Undertake administrative management (identification of the user and attribution of the mKaart) and operational management of the mBox service;
- Realise actions for information and awareness-raising/prevention aimed at users;
- Communicate alerts in the event of malfunctions identified with mBox facilities;
- Manage the business (production of statistics on activity and frequency of use, satisfaction surveys, etc.).
This processing envisages the mandatory gathering of the data required to process the request. It means that the person submitting the request is obliged to provide the information demanded, in order to be able to benefit from the “mBox Product and Service”. The collected data are first name, last name, postal address, e,ail address and mKaart number. The fact of not supplying the required personal data will be an obstacle to supply of the mBox product.
9.2. The user’s personal data is retained throughout the time that the mBox service is used, and for a period of one year following the end of use of the service.
9.3 The mBox facilities are subject to video surveillance by the company Securitec, for the safety of users and of their property. The images are retained for forty (40) calendar days, and may be viewed by authorised personnel of the Public Transport Board and by the police.
The images are automatically deleted after the 40th calendar day following their recording, unless the user has lodged a complaint with the police before the end of this period. In the context of a police search, the images may be stored for a maximum period of six (6) months.
9.4 The user can access and obtain a copy of the data concerning him/her, can object to processing of his/her data, and can have data corrected or erased. The user also has a right to restrict the processing of his/her data. 9.5 A claim, complaint or request in relation to the rights of users may be lodged as appropriate with the National Data Protection Commission (Commission nationale pour la protection des données) at 15, Boulevard du Jazz, L-4370 Belvaux.
9.6. By signing, the user declares that he/she has taken note of the stipulations of these general terms and conditions and expressly accepts them.
9.7. By signing these general terms and conditions, the user expressly accepts processing of his/her personal data for performance of the “mBox Product and Service” contract.
