The administration des transports publics (ATP), 4, rue Charles Bernhoeft, L-1240 Luxembourg, is responsible for the “Mobiliteit.lu” app. With this application, the ATP provides private individuals (“users”) with a multimodal route planner, including the option of creating a profile, a map function and travel advice for the country of Luxembourg and the border region.
By agreeing to these Terms of Use, users agree with all of the following points. Only all the points listed here apply to use of the application. Where third-party services are involved, on account of the multimodal nature of the application, the terms and conditions of those third parties apply.
2.1 With the Mobiliteit.lu app, users can set up a personalised account, server- or device-based, and either across multiple devices or not, for the purpose of saving and calling up their own transport preferences
2.1.1 Users are not obliged to use the app to set up a server-based account. If the user agrees to create a server-based profile, the terms relating to data protection and liability in Section 6 apply and the user confirms their acceptance of the ATP’s GDPR statement. Server-based accounts are held by HaCon Ingenieursgesellschaft mbH in Hannover. When a server-based profile is created, the following information may be collected about an individual:
Deleting the app does not automatically mean that the server-based account is also deleted. Only when the account is deleted in the account settings is it deleted from the server. A deleted account cannot be reinstated. The principle of “deleted is deleted” applies.
2.1.2 When a device-based account is created, all personal information and transport profiles are saved exclusively on the device. In this case, the user is only able to save their own transport preferences. Personal details such as those listed in 2.1.1 are not collected. When the app is deleted, these are also deleted, unless the user takes appropriate countermeasures, depending on their device.
2.2 With the Mobiliteit.lu app, users can use the multimodal route planner, the map including all transport services, and functions based on their location search, in order to plan a route. The following functions are also available to users: saving their own favourites, saving recently searched routes, entering preferences in “My Mix” (a special personalised page for searching for transport services where users can select, deselect and combine all modes of transport), defining search parameters (footpath to the stop), etc. The Mobiliteit.lu app draws on data belonging to the ATP and data from third parties (bike sharing service providers, charging station operators, lift-sharing options, car park and P+R operators) and traffic messages from the administration “Ponts et Chaussées”, the “ACL – Automobile Club du Luxembourg” and “HereWeGo”.
2.3 Transport routes and real-time information
The transport routes that are shown always constitute a snapshot of the situation at the time when the user begins their search so they may be partly based on estimates by the system. These estimates by the system may be related to its latency times. The transport routes and real-time information produced at any one time may change constantly (e.g. the number of available charging stations at arrival, real-time information about public transport departure times, traffic situation etc.). Consequently, journeys may be delayed, disrupted or cancelled as routes are being worked out, or afterwards. Users must take this into account.
The ATP does not check that real-time information provided by third parties is either correct or complete. Rather, it is up to users to check whether that data serves their purposes.
2.4 User’s responsibilities
In the case of all transport services provided by third parties, users are themselves responsible for ensuring that they satisfy all the requirements for using them (e.g. they have taken out a subscription for using bike-sharing services or they hold a driving licence for offering lift-sharing). Users are also responsible for ensuring that the capabilities of their device (whether mobile or desktop) will allow them to use the transport information as required.
3.1 By agreeing to the use of their location while using Mobiliteit.lu, users agree that their location at the time of making their search may be transmitted and used in order to work out journeys and show the user’s position on a map. The location services on the relevant device need to be activated.
3.1.1 When routes are being worked out, the user’s location may be identified once per route search and sent to the computing centre of HaCon Ingenieursgesellschaft mbH in Hannover. The data is encrypted on the server and treated as confidential while the route is worked out. Movement patterns for searches can only be collected for each specific route query (start or destination) and not continuously.
3.1.2 The user’s current location may be displayed in order to depict their position on a map. This is for orientation purposes and their position may be depicted continuously as a mark on the map view (a dot or similar). As under Section 3.1.1, movement patterns are not collected continuously but at specific points when the user’s position needs to be entered as the start or destination point on a map view.
3.2 If consent is not given for the user’s location to be identified while they are using the Mobiliteit.lu app, then the user cannot use their location to work out a journey or to show their position on a map
4.1 The ATP does not charge for use of the app. However, a user’s mobile phone provider may charge for making the Internet connection. Users are responsible for any communication costs.
4.2 The Mobiliteit.lu app is for personal use only. Any business or commercial use of the app requires written permission in advance from the ATP.
4.3 Users themselves are responsible for any costs arising from use of the modes of transport and third-party services that are shown. The cost of transport services provided by third parties is in accordance with the terms and conditions of the relevant service provider.
4.4 All costs quoted in the application are the responsibility of users themselves. The ATP accepts no liability if costs differ from those quoted.
5.1 The ATP accepts no liability for the accuracy or completeness of data provided and displayed by third parties. It is up to users to check the accuracy of the data for themselves.
5.2 The ATP offers no guarantees and accepts no liability for third-party transport services. In the event of any questions or claims relating to a transport arrangement or its implementation, users should always contact the transport service provider.
5.3 Users are responsible for the capabilities of their mobile device.
6.1 General data protection information
Protecting your personal data is very important to us. That is why, before you start, we want to tell you about how we protect your data when you use our app.
It is entirely possible to use our app without entering any personal data. However, if you wish to take advantage of certain special functions of our app (e.g. localisation), we may need to process some personal data. We guarantee that we will only collect and use personal data where this is necessary in order to provide you with a fully functioning app and all our content and services.
As the body responsible for processing the personal data that is collected, the ATP undertakes to use the data as defined under the EU General Data Protection Regulation 2016/679 (hereinafter “GDPR”).
6.2 Data collection and processing
HaCon Ingenieursgesellschaft mbH only collects and processes your data for specific purposes. It may be required for technical reasons or to meet specific user requests.
6.3 How long is data stored for?
We only save your data for as long as is required to serve the purpose for which it was collected or for as long as is legally required. The data is then kept for the legal retention period of 6 months.
6.4 Where is data stored?
Users’ personal data which is server-based is stored and kept on servers operated by HaCon Ingenieursgesellschaft mbH in Hannover in Germany.

The ATP does not check the content of these linked Internet pages or applications regularly and for that reason cannot accept any liability for their content, vouch for its validity or even state whether the content that is displayed is accurate.

All content displayed by the application is subject to intellectual property law and copyright law and is protected by the ATP.
Unless otherwise stated, the ATP does not consent to the licensing or transfer of the copyright relating to the application and its content. They remain the intellectual property of the ATP. Unless otherwise stated, users may consult, download and print out documents and information from the application, subject to the following conditions:
